1. Service Description

FlyClaim is a service that helps Canadian air travelers identify eligible flight delays and cancellations, and assists in submitting compensation claims under the Air Passenger Protection Regulations (APPR). We connect to your Gmail to find flight confirmation emails from Air Canada and track your flights for delays.

2. User Obligations

By using FlyClaim, you agree to provide accurate information, maintain the security of your account, and not misuse the service for fraudulent claims. You must be at least 18 years old or have parental consent to use this service.

3. Fee Structure

FlyClaim charges an 18% success fee on approved compensation claims, with a maximum fee of $180 CAD per claim. This fee is only charged when your claim is successfully approved and you receive compensation. After your first successful payment, you receive lifetime access to FlyClaim with no additional fees.

4. No Guarantee of Success

While we strive to accurately identify eligible flights and submit complete claims, we cannot guarantee that any claim will be approved. Airlines make final decisions on compensation claims based on their own assessment of circumstances.

5. Limitation of Liability

FlyClaim is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the fees you have paid to us.

6. Dispute Resolution

Any disputes arising from these terms or your use of FlyClaim will be resolved through binding arbitration in accordance with Canadian law. You agree to attempt informal resolution before initiating any formal proceedings.

7. Account Termination

You may delete your account at any time through the settings page. We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity. Upon termination, your data will be handled according to our Privacy Policy.

8. Intellectual Property

All content, features, and functionality of FlyClaim are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the service without our written consent.

9. Changes to Terms

We may update these terms from time to time. We will notify you of significant changes via email or through the service. Your continued use of FlyClaim after changes are posted constitutes acceptance of the updated terms.

10. Governing Law

These terms are governed by the laws of Canada and the province of Ontario, without regard to conflict of law principles. Any legal proceedings will be conducted in the courts of Ontario, Canada.
